Terms of Service
For the use of Motionstash, last updated October 13, 2026. Motionstash is a brand of Speakwise GmbH. With Motionstash you connect an AI assistant such as Claude or ChatGPT to our MCP server and have it make motion graphics videos. This is a translation for your information; the German version prevails.
1. Provider and scope
The service is provided by Speakwise GmbH, Kollage 3, 49170 Hagen a.T.W., Germany, represented by its managing director Nicolas Hagedorn, registered at the Amtsgericht Osnabrück under HRB 221332 ("we"). Contact: hallo@speakwise.agency, phone +49 5401 1523001.
These terms apply to the MCP server at mcp.motionstash.io, your account, the videos made with it and the website motionstash.io with its component library. They apply to consumers and to businesses; where a rule applies to only one of them, it says so. Conflicting terms of a customer do not become part of the contract, even if we do not object to them.
2. Who sells and who performs: Lemon Squeezy as Merchant of Record
You buy paid plans and credit packs from Lemon Squeezy, LLC, USA ("Lemon Squeezy"). Lemon Squeezy is our reseller and Merchant of Record: it is your contracting party for the purchase, takes the payment, calculates and remits VAT or sales tax, issues the invoice and processes refunds. Lemon Squeezy's buyer terms, shown at checkout, also apply to the purchase.
We provide the service itself. The contract for the use of Motionstash is made between you and Speakwise GmbH: on the free plan when you sign up, on a paid plan when you complete the purchase with Lemon Squeezy. These terms govern that contract.
3. The service
Motionstash is an MCP (Model Context Protocol) server. You connect it to an AI assistant you use yourself, such as Claude by Anthropic or ChatGPT by OpenAI, and order videos through it: logo reveals, product clips, launch films, captions, edits of your footage and similar. We create the concept, the animation and, where needed, voice and sound, and render the video on our servers in Frankfurt, Germany.
The assistant is governed by its provider's terms. It is not part of our service, and we are not responsible for its availability or its answers.
Videos are made with the help of AI models. Results may differ from the request and are not exactly repeatable. We owe a video that substantially matches the request and plays without technical faults, not a particular creative result. Change rounds are available within your plan.
4. Plans and credits
All plans are billed monthly:
Free$0, 2 films a month
Creator$19 a month, 10 films a month
Pro$49 a month, 30 films a month
Studio$149 a month, 40 films a month
Consumers see the final price including VAT at checkout, calculated by Lemon Squeezy for your country. The price shown at checkout applies.
Each video uses credits. How many depends on the kind of video and is shown to you before it starts; a video starts only when you have enough credits. If a step fails for a reason on our side, it costs no credits.
Monthly credits are valid for their billing period. Unused monthly credits expire at the end of the period and do not roll over, unless the plan states otherwise. You can also buy credit packs at the prices shown at checkout. Credits from packs do not expire while your account exists and are used after your monthly credits. Credits have no cash value, cannot be transferred and are not paid out; statutory rights remain unaffected.
5. Free plan
The free plan is for trying the service. It is limited to template videos, at most 720p, videos of up to 15 seconds, one change round per video, a watermark and the standard voice only. A free account requires a company email address; addresses from free email providers and disposable domains are not accepted for the free plan. One free account per person and company. There is no claim to the free plan or its scope; we may change or end it with reasonable notice.
6. Term, cancellation and price changes
Paid plans run monthly and renew for another month unless cancelled. You can cancel at any time to the end of the current billing period, in the Lemon Squeezy customer portal linked in every receipt, or by email to us. The plan stays usable until the end of the paid period; then the account returns to the free plan. An upgrade takes effect immediately, a downgrade at the end of the period. The right to terminate for good cause is unaffected.
We change the price of a running subscription only after notice by email at least 30 days before it takes effect. The new price applies from the first billing period after that notice period, and you can cancel with effect from that date; the notice will tell you so. For consumers we raise a running price only with their consent; without it, we may end the subscription when the price change takes effect.
7. Right of withdrawal and refunds
Consumers have a statutory right of withdrawal. The details, the model withdrawal form and our voluntary refund rules are in the refund policy.
8. Your account and fair use
You sign in by email link or with a Google account. You must be at least 18 years old, your details must be correct, and you keep your sign-in and the connection between your assistant and our server secret. What is ordered through your account counts as ordered by you, unless you are not responsible for a misuse and tell us about it without delay.
The service is meant for people using it through their assistant. You may not use it in a way that impairs the service for others, for example by mass automated orders, bypassing quotas or blocks, reselling access, holding several free accounts, or trying to extract or bypass safeguards, models or instructions of our servers. A Studio plan includes three seats for people of the same customer.
9. Your content and prohibited content
You can upload or name material such as logos, brand marks, screenshots, footage, text, music, a voice sample or the address of your website. You warrant that you hold the necessary rights, including rights to brands, names, images and the voices of people shown or heard. If we read your website at your request to take over colours, fonts and logo, you warrant that you may use that brand. We create a copy of a voice only at your express request and only of your own voice or with the proven consent of the speaker.
You grant us the simple right, limited to the term of the contract, to store and process your material and pass it to the service providers named in the privacy policy as far as needed to make and deliver your videos. We do not use your material or your videos for advertising or to train AI models.
You may not order content that breaks the law or infringes the rights of others, in particular: depictions of child sexual abuse or sexualised content involving minors, pornographic content, glorification of violence, incitement to hatred and terrorist propaganda, harassment and threats, deception about real people (such as deepfakes or imitated voices without consent), misleading advertising, content that infringes trademarks or copyrights, and material for committing crimes or fraud. We may refuse such orders, remove content and, for serious or repeated violations, suspend or terminate the account. Credits already used are not refunded in that case.
If third parties make claims against us because of your material or a video you ordered, you indemnify us against those claims and the reasonable costs of legal defence, to the extent you are responsible for the infringement.
10. Rights to your videos
The finished videos are yours to use. To the extent any rights in a video belong to us, we grant you on delivery the simple, transferable right, unlimited in time and territory, to use, edit, publish and advertise with the video, privately and commercially, also after the contract ends. Videos with the free plan watermark may be used the same way, but the watermark may not be removed.
Music, voices, stock footage and fonts used in videos come from sources whose licence allows use within the delivered video. Using those parts outside the video, such as the music file on its own, is not included. Content generated by AI models may not be protected by copyright under German law; we therefore do not promise that you can stop others from using similar content. You keep all rights to your own material.
11. Availability, storage and changes to the service
We aim for high availability but do not owe uninterrupted service. Maintenance, outages at service providers or at the AI assistant and force majeure may limit the service at times. For paid plans the statutory rights for defects in digital products apply (for consumers, §§ 327 et seq. of the German Civil Code, BGB).
We store uploaded material and finished videos for your account so you can download them and have them edited. We delete them 90 days after your last activity in the service, earlier on request, and at the latest 30 days after the account is deleted. Drafts and previews may be deleted earlier. Please keep videos you want to keep on your own storage.
We develop the service further and may change it as long as the agreed scope is not materially reduced and the change is reasonable for you. For consumers § 327r BGB applies: we inform you in good time about a change that affects you negatively, and you can then end the contract free of charge within 30 days.
12. Component library and website
The library on motionstash.io is free and needs no account. Components we wrote are licensed under the MIT licence, copyright Speakwise GmbH: you may copy them, change them, build them into your own projects and use the rendered videos privately and commercially. The copyright notice and licence text stay with copies of the source code; a rendered video needs no notice. Ported components carry the licence of their original project, whose notice is in the file header and on the component page.
Fonts used by components are licensed under the SIL Open Font License. The website's interface font, General Sans, is licensed by the Indian Type Foundry and is not included. The website itself, its texts, its design, the name Motionstash and the logo are not under an open licence; you may name and link to us, but not present your own offer as Motionstash.
The registry data (registry.json, llms.txt, feed.json) and the npm package motionstashmay be read automatically, also commercially. Access that impairs operation or bypasses safeguards is not allowed. For the free library the MIT licence's disclaimer of warranty applies, unless we fraudulently concealed a defect; liability follows section 13.
13. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee we gave.
For slightly negligent breach of an essential contractual obligation, meaning an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely (cardinal obligation), our liability is limited to the damage typical for the contract and foreseeable when it was made. Otherwise liability for slight negligence is excluded.
These rules also apply to our legal representatives, employees and agents. For the free plan and the library, § 521 BGB applies accordingly: we are liable there only for intent and gross negligence, except for injury to life, body or health. Your statutory rights for defects in digital products remain unaffected.
14. Changes to these terms
We may change these terms for the future if the service, the law or case law changes and the change does not shift the balance of performance and price to your disadvantage. We announce changes by email at least 30 days in advance. Material changes, in particular to prices and scope, apply only with your consent. The current version is on this page with its date.
15. Governing law, jurisdiction, dispute resolution
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection rules of that country remain unaffected.
If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Osnabrück, Germany. We may also sue at the customer's seat.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Please write to us if something is wrong.
If a provision of these terms is invalid, the rest remain valid. The contract language is German. This English version is for your information; the German version prevails.
